Jaqueline Cherulli, master’s student in Philosophy by Unisinos. Post-graduate in Constellations applied to Systemic Law by Hellinger Schule, Hellinger Sciencia, Innovare. Specialization in Judicial Power – MBA – by the Getúlio Vargas Foundation – FGV – Extension in Structural and Systemic Constellations by SySt®. Extension in Organizational Constellations by Hellinger®schule. A precursor of the Law 13.058/2014 – (Shared Custody) – and author of the text that justified the bill that changed the Brazilian Civil Code. Speaker at numerous national and international congresses, about shared custody, parental alienation, systemic law, systemic view of law and the application on systemic justice in the Judicial Power. Idealizer of the Primer of Shared Custody and the Primer “Don’t hide, report it!”, informing children, teenagers and family about bullying and psychological, physical and emotional violence, both published and distributed by the Justice Court of Mato Grosso State. A SYSTEMIC VIEW WITHIN THE SCOPE OF THE BAZILIAN JUDICIARY

Having a systemic consciousness allows us to adopt, from a perspective where we look at the big picture, a posture that leads to the analysis of the situations and relationships in a wide, connected, and humanized way. I am in the Judiciary Power for little over 22 years and perform in family areas in the last 17 years ago. But it was only in 2015, that I proposed to work in the Judiciary Power of the State of Mato Grosso with Systemic Law – expression that began to be included and registered in the Brazilian juridical order, by means of the Court of Justice of Bahia judge, Sami Storch, who introduced Hellinger’s reflections in the scope of the Brazilian judicial power, by making use of the philosopher’s teachings to ground his understanding and performance in the search for law and justice to all. What began as an intimate project, but a bold one, today represents a program focused on the procedural questions in which works are performed in the 1st degree processes and in the appeal processes in the TJMT.

The program was adjusted and, during the covid-19 pandemic, resulted in the “Systemic Integrative Experiences”, project that I developed from the knowledge and experience exchange acquired about the Hellinger’s teachings and with which we are preparing to act also in the pre-procedural questions of the PTJMT (Judiciary Power of the State of Mato Grosso).

The adoption of practices guided by the philosophical science of Bert Hellinger, allows for a performance turned to request and litigation reduction in the Judiciary Power by means of integrative movements and approaches which seek to pacify, and at the same time that, the litigations inserted there, translate into an increase in the percentile of resolution due to the pre-procedural and procedural reconciliation.

By approaching the “systemic” question, coming from Hellinger’s science, we seek to present a vision that foresees the perception of the interactions between the parts to the composition of the whole. It’s about recognizing the existence of hierarchical organized systems, which, in each level of complexity, possess properties that cannot be understood fully if they are only taken into consideration isolated from each other, since, in each level, the whole will always be more than the sum of its parts, understanding which is also represented in R. Sheldrake studies.

In that sense, Systemic Justice, in the light of Hellinger’s conception, dialogues with the Multidoor System made available by PTJMT, since it possesses in its core “a non-formal way to act to which we call posture. Hence the fundamental key of Systemic Justice: the Law provides what-to-do. On the other hand, the systemic principles and its posture articulate the how-to-do – the posture.” (OLIVEIRA JUNIOR, s.d.)[1], showing as a substantiated approach and supported by law, which allows the adoption of dynamics that access what exists behind the conflict between people who search for the judiciary, promoting, in this way, the conciliation and aggregated solution to a reconciliatory and pacifying result and, beyond rates and institutional goals, a true reconciliation of the being with himself.

Such skills – combined to knowing how to do – developed within Hellinger’s conceptions, took me to adopt a posture of non-judgement, that doesn’t “make” solutions, that doesn’t wish to save anyone, but one available to look at each individual and his/her destiny, with respect. To listen to every story with no intention to intervene. To deal with the conflicts that are presented with an exempt observation, in which it becomes possible to identify the feeling, the unattended need of the individual and, with that, brings light to the implicit request, and from it the exempt view of judgement, that welcomes everything and excludes nothing.

From this conclusion, active listening is developed; the expressed need is accepted and the person and the need are seen, and, from that stage, we can contribute, by showing a new way to “look” to the question e with that to facilitate the path that may lead to a pacifying result for the involved parts, since by undertaking on the Hellinger science, with posture (Systemic Justice), in the field of Systemic Law, it becomes possible that each case is redirected to the most appropriate method to its resolution.

The relevance of events that act to spread this systemic vision in the judiciary scope allows that a new way to understand the facts that transcend the relationships of those who take part in the process to be taken to the law exercisers, since knowing these differences helps to find a more effective solution to the controversies, liberating, at the same time, the parts to resume and follow with their lives.

Mª Luz Godoy Ruiz, born in Madrid, she is Founder and Director of the Nadir de Murcia Center.

Family and Minors lawyer, Mediator, Maternity Coordinator, Bachelor’s in psychology and Psychotherapy by FEAP.

Titular member and Psychotherapist at AECFS (Spanish Association for Familiar and Systemic Constellations).

She practised advocacy for more than twenty years, specializing in Family and Minors Law, Abuse, Child Sexual Abuse and in Human Rights at the International Institute for Human Rights at Strasburg. She collaborates with different NGOs and multidisciplinary teams. She gives training to different professional groups in these matters.

Convinced of the need for a multidisciplinary approach in conflict resolution and family abuse, she is trained in different branches of Psychotherapy and Humanist Psychology.

University degree in Gestalt Therapy, Enneagram (SAT Program), Integrative and Bioenergetic Clinical Psychotherapy, Family Constellations, Organizational Constellations and Systemic Coaching, Mediation, Parental Coordination. Finished her training in the Psychology Colleges of the Universities of Murcia and Cudec in Mexico, where she finished her Bachelor’s in psychology.

Since 2007 she has been running workshops related to these disciplines.

Defender for multidisciplinary and personal, family and work conflict resolution mediation, she created her own centre, where she integrates her two main occupations and professionals in the juridical and psychological areas, who promote techniques for the peaceful resolution of conflicts, such as Mediation and Systemic Constellations.

The growing interest and trust in the importance of the systemic methodology have brought her closer to different professional groups in the juridical, medical, and educational areas, having performed investigation work in the first two. She is a pioneer in Murcia in the application of Systemic Law and Legal Constellations since 2012.

Sami Storch, graduated from the Faculty of Law of the University of São Paulo (USP)

Author of the expression “Systemic Law” and the blog with the same name.

He received awards from the Court of Justice of Bahia and from the National Council of Justice for innovation in the practice of family constellations and application of the systemic orders discovered by Bert Hellinger in the conduct of proceedings, obtaining a high rate of reconciliation and harmonizing systemic solutions in several areas.

He gives lectures and courses in Brazil and abroad. Professor at Hellinger School (Germany) and academic coordinator of the Postgraduate Course in Systemic Law at Hellingerschule/ Faculty Innovare.

The practice of advocacy in the light of systemic law

Currently, we have observed that many lawyers have been dissatisfied with their work and with the view that society has in relation to their role as a conflict manager.

The professional’s daily routine is stressful: courts that are unable to cope with the demands that arise every day to the thousands and clients that demand a quick response to their demand. And the lawyer, believing that he is unable to deal satisfactorily with the cases, suffers from constant frustrations and illnesses.

In this same context, on several occasions, it is evident that a judicial sentence does not end the conflict, since it is common for the client to return to the office to be proposed new demands that have connection with the initial dispute, even after having his request initial satisfied.

Thus, one of the possible paths that can be taken by lawyers is to adopt a systemic look at the conflict, which enables their client to put a definitive end to the demand.

The lawyer can use systemic law which, according to the definition of its creator, the Brazilian judge Sami Storch, is the analysis of law from a perspective based on Bert Hellinger’s philosophical approach, which leads his clients to a solution and which it brings peace and balance to the entire system, be it family, organizational or any other system by which they belong. In this sense, systemic law is not a new branch of law, but rather, it opens the way for the jurist to have a systemic view not only for any area of ​​law.

Therefore, I invite everyone to participate in the conference “The practice of advocacy in the light of systemic law”, in which we will explore the possibilities that these legal professionals have to work to lead their clients to new possibilities to solve their problems. issues in this field.

Nídia Brito da Costa, graduated in Law from the Catholic University of Lisbon in 1994, post-graduated in Administrative Law from Universidade Lusíada in 1995, Jurist at the Portuguese Council for Refugees and practicing law until 1999. Joins as coordinator of the Civil Liability department from Gerling (Hannover-Gerling) from 1999 to 2004, when she started working as director of the civil liability department at Aig (American Insurance Group) from 2004 to 2016. She took the Family Constellations facilitator course at Espaço Psi (2012 -2014) facilitated by Paula Matos and in 2016-2017 the Family Constellations facilitator course by EDT, facilitated by trainer José Miguel Silva, having participated in several workshops and family constellation days (namely at Camp Hellinger), is a facilitator of Family Constellations since 2014. Since January 2018 I research and learn about Systemic Law, exploring the application of philosophy Hellingerian to law, having co-organized the I Systemic Law Meeting at the Faculty of Law of Lisbon and the I Course on Systemic Law facilitated by Judge Sami Storch, in Portugal. Systemic Law Workshop

The aim of this workshop is to present the concept of systemic law and give the participant basic notions of the philosophy of Family Constellations according to Bert Hellinger and ways of applying (by the various professionals) to law and conflict resolution in general, in order to see how it can gain additional skills to develop your activity more effectively for all and more peaceful.

The participant will have basic notions about the systemic laws applied to relationships and systems, what the personal and professional effects of their observance and non-observance are and what the systemic posture consists in very briefly.

 

Examples and practical exercises for beginners and possible will be given in two hours of workshop that awaken this new look and systemic stance and its application to the extrajudicial and judicial legal field.

SYSTEMIC JUSTICE: TRANSFORMING CONFLICTS, RELATIONSHIPS AND LIVES.

The vision of justice as a mere enforcer of the law has not been able to answer the most essential problems of humanity, especially in this postmodern scenario, which witnesses so many paradigmatic changes in the way of perceiving the world. What then would the role of Justice be? Justice is not only an enforcer of the law, but also an important protagonist of the culture of peace, which sees conflict as an opportunity for qualitative transmutation of human relations. And as such, it breaks standards and develops creative ways for the propagation of peace, including using other knowledge, such as Bert Hellinger’s systemic thinking and Philosophy, which allow him to broaden his view of conflict, to perceive systemic dynamics hidden and other factors that generate it, and approach it with a transformative bias to the detriment of a merely retrospective bias. In doing so, justice inspires and encourages people to develop self-knowledge and to act with self-responsibility, respect, empathy and collaboration, realizes its primary objective and places itself at the service of peace and human evolution.

WORKSHOP

NEW SYSTEMIC PARADIGMS IN CONFLICT MANAGEMENT: IT IS NECESSARY TO INTERNALIZE TO IRRADIATE.

Nobody can give what they don’t have. Therefore, in order to properly manage the conflict of others, it is necessary to improve self-knowledge and internal resources. Through exercises and systemic experiences, this workshop aims to invite students to reflect on the systemic laws that move each one in their decisions and behaviors for a better understanding of themselves and the other; the need to broaden the view of the conflict, realizing the hidden systemic dynamics that generate it and approaching it with a transformative bias to the detriment of a merely retrospective bias; the need to act with systemic empathy in conflict management; the need to expand the potential for new forms of knowledge and work. Thus, the workshop aims to nurture a new model of Justice, which addresses conflict in a systemic and interdisciplinary way, leading students to a new legal consciousness, based on the teachings of Bert Hellinger and on systemic thinking, awakening them to a transformation personal and professional.
